Who we are
These Terms of Service (“Terms”) govern your access to alanamurray.com and any subpages (the “Site”) and your purchase or use of our digital products and services, including templates, guides, checklists, frameworks, and related educational materials (collectively, “Products”). SCADA & Beyond with Alana (“we,” “us,” “our”) provides the Site and Products.
By accessing the Site or purchasing/using the Products, you agree to these Terms.
1. Scope of Services & Educational Purpose (No Professional Advice)
Our Products are educational and informational. They provide general guidance based on industry experience and are not engineering, legal, or professional advice for any specific project. You are responsible for your decisions and outcomes. You must consult qualified engineers, system integrators, and relevant authorities before design, selection, or implementation. You must ensure compliance with all applicable codes, standards, and regulations in your jurisdiction.
2. Accounts; Eligibility
You must be of legal age to form a contract and use the Site and Products. You are responsible for the security of your account credentials and for all activities under your account.
3. Orders, Pricing, Taxes & Payment
We use SureCart to operate our store/checkout and Stripe/PayPal to process payments. Prices may change without notice until you place an order. You are responsible for any applicable taxes. We do not store full payment card numbers on our servers.
4. Delivery of Digital Products
Digital Products are delivered electronically (e.g., download links, email receipt, or account access). We may update or replace files to correct errors or improve clarity at our discretion.
5. License to Use (What you may do)
Upon purchase, we grant you a limited, revocable, non-exclusive, non-transferable license to use the Product:
Individual License (default): One natural person may use the Product for personal learning, internal work, and internal presentations within their employer.
Team/Enterprise License (if purchased): Use is limited to the number of seats or sites specified at checkout.
You may adapt the Product for internal use (e.g., fill in blanks, adjust fields), provided you retain any included disclaimers and do not redistribute the adapted materials outside your organization.
6. Prohibited Uses (What you may not do)
Unless you have our prior written permission, you may not:
- Share, post, publish, sell, sublicense, rent, or otherwise redistribute the Product or any substantial portion of it outside your organization;
- Use the Product to create a competing product or library for distribution, or train an AI/model to reproduce our materials;
- Remove proprietary notices, disclaimers, or attribution statements included with the Product;
- Misrepresent the Product as “certified,” “approved,” “validated,” or as a “standard/specification”;
- Provide professional engineering services, stamped designs, or regulatory submissions based on our materials without independent professional review.
7. Attribution (public use)
If you publicly display excerpts (e.g., in a slide deck or report shared outside your organization), include “Based on the [Product Name] by SCADA & Beyond with Alana.”
8. Intellectual Property
All content, examples, and methodologies are our intellectual property and protected by copyright and other laws. No ownership transfers to you; only the license above.
9. Third-Party Services & Links
We rely on third-party services (e.g., SureCart, Stripe, PayPal, and WordPress plugins) and may link to third-party sites. Those providers operate under their own terms and privacy policies. We are not responsible for third-party content, downtime, or actions.
10. Refunds & Right of Withdrawal (Digital Content)
Because Products are digital and accessible immediately after purchase, all sales are final, except where required by law.
EEA/UK customers: by accessing the download immediately, you consent to immediate performance and acknowledge your right of withdrawal is lost under applicable consumer laws. If you prefer to keep the 14-day withdrawal right, do not access the download until the withdrawal period ends.
11. Updates; Availability; Changes
We may modify, suspend, or discontinue any products or features at any time. We may provide updates or replacements at our discretion. Availability can change due to maintenance or third-party outages.
12. Accessibility
We strive to make our Products accessible to people with disabilities. If you encounter accessibility issues with any of our Products, please contact us at alana@alanamurray.com so we can work to provide content in an alternative format.
13. Feedback
If you send ideas or suggestions, you grant us a non-exclusive, worldwide, royalty-free license to use them without restriction or obligation.
14. No Warranty (AS IS)
To the fullest extent permitted by law, the Site and Products are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
15. Limitation of Liability
To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Site or Products will not exceed the amount you paid for the applicable Product in the 12 months preceding the claim. We are not liable for any indirect, consequential, exemplary, incidental, special, or punitive damages, or for loss of profits, data, goodwill, or business interruption.
Some jurisdictions do not allow certain exclusions or limitations; in those cases, the above applies to the maximum extent permitted by law.
16. Indemnity
You agree to indemnify and hold us harmless from claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your misuse of the Products, violation of these Terms, or infringement of any third-party rights.
17. Governing Law; Venue
These Terms are governed by the laws of Nova Scotia, Canada, without regard to conflict-of-laws rules. You consent to the exclusive jurisdiction and venue of the provincial and federal courts located in Nova Scotia for any dispute not subject to informal resolution.
18. Termination
We may suspend or terminate access to the Site or Products if you violate these Terms. Upon termination, your license ends, and you must cease use and delete copies, except for materials already embedded in internal work product created before termination.
19. Export & Sanctions
You may not use or export the Products in violation of applicable export control or sanctions laws.
20. Privacy
Your use of the Site and Products is also governed by our Privacy Policy and Cookie Policy (linked in the footer). Please review them to understand how we process personal information.
21. Changes to These Terms
We may update these Terms from time to time. The “Last Updated” date shows the latest version. If changes materially affect your rights, we will take reasonable steps to notify you (e.g., banner or email, if you’re subscribed). Continued use after changes means you accept the revised Terms.
22. Miscellaneous
No waiver. Our failure to enforce any provision is not a waiver.
Severability. If any provision is unenforceable, the rest remains in effect.
Assignment. You may not assign these Terms without our consent; we may assign them as part of a reorganization or sale.
Entire agreement. These Terms (plus policies referenced here) constitute the entire agreement regarding the Site and Products and supersede prior understandings.
